Terms of Service
Last updated: 10 November 2026
Version: 2026-11-10 · In force from 10 November 2026.
These Terms govern the use of Cheerlify, a private race-day tracking and cheer service. The Terms must be expressly accepted at sign-up; followers (supporters without an account) are informed about them when they join and before they send a recording.
Please note in particular the following terms, which may differ from what is usual or be to your disadvantage, and which you accept separately at sign-up: the service is not a safety, emergency or navigation tool, and you bear the risks of running and of playback while running (section 9); you accept the risks of sharing your live location (section 9.3); the limitation of our liability and the cases excluded from it (section 10); that we are not responsible for what third parties send you (sections 9.5 and 10.4); removal of content, suspension of access and bans (section 7); the licence you grant for your content (section 8); the limited retention of cheer recordings (8.4); credits and packs lost when an account is deleted (5.5); and your obligation to reimburse costs caused by your unlawful content (10.5). They are also set in bold in the text.

2. Conclusion, language and storage of the contract
2.1. The contract is concluded electronically: for account holders by expressly accepting these Terms at sign-up, for followers by joining a race and sending a recording. The contract can be concluded in Hungarian or English: the language version in which you use the app or the website applies, and both versions are equally valid. If the two versions differ in interpretation, the Hungarian version prevails.
2.2. The steps of sign-up: entering an e-mail address, password and display name (or Apple/Google sign-in), accepting the Terms, then confirming the e-mail address with the code you receive. You can correct what you typed at any time before submitting; after that, you can change your profile details in the app. The provider does not file the contract separately; the accepted version of the Terms and the time of acceptance are recorded with the account. The current and earlier versions remain available and downloadable on the website at their own address.
2.3. The provider has not signed up to any code of conduct.
2.4. You must be at least 16 years old to register and to use paid features; you confirm this expressly at sign-up. If we learn that an account was created by someone under 16, we delete it.
2.5. The service is for your own, private use. Business use (e.g. race organisers, clubs or teams tracking many runners) requires a separate agreement — write to support@cheerlify.com.
3. The service
Cheerlify lets a runner share a private link and race code so friends can follow their race live on a map and send voice or video cheers that play in the runner's earbuds mid-race.
Alongside free live tracking, we offer paid products. Their main characteristics:
- Race packs (e.g. Race Pack, Marathon Pack): apply to one race and unlock more viewers, video cheers, longer cheers and further features for it. A pack belongs to that race and cannot be moved to another.
- Cheer credit bundles: allow a set number of cheers to be sent; credits belong to your account and carry over between your races.
- Season Pass: a one-year, account-level entitlement that automatically equips every race you create during its term with the top pack and unlimited cheers. It does not renew: it does not extend and does not charge again at expiry; races created before expiry keep their pack afterwards.
- The current content and price of each product is shown in the app before purchase (and, for information, at cheerlify.com/pricing). Prices are consumer prices including tax; the exact price for your country and currency is shown by the app store before you confirm.
- Technical requirements: the app needs the operating-system version stated on its app store page (on Android at least Android 8.0), GPS and mobile internet for tracking, and earbuds to hear cheers; the follower website needs a modern browser. The app and the website do not interoperate with other software and contain no technical protection measures (DRM).
- The service is available in the European Union and the European Economic Area. We accept no responsibility for use from other countries or for compliance with the laws there.
3.1. Referral programme and promotional credits. From time to time we give free credits or pack vouchers (e.g. when someone you invited signs up, or as part of a promotion). These are gifts: they have no cash value, cannot be transferred, and we may change the programme's conditions — including the conditions for granting and the end of the programme — at any time. Abuse of the referral programme (e.g. inviting your own fake accounts) leads to the credits being revoked.
4. Accounts, runners and followers
4.1. Runners create an account to set up and run races. You are responsible for keeping your login secure and for the races and content you create. One person may use one account; give true details at sign-up and do not hand your account to anyone else. If you notice unauthorised access to your account, tell us at once at support@cheerlify.com.
4.2. Followers join anonymously with a link, an access code and a display name — no account is required. Do not share a race link or code with anyone the runner would not want watching. The display name must not be misleading (e.g. another person's name) or offensive.
4.3. The runner's responsibility at the race. The runner is responsible for using Cheerlify — in particular earbuds, the phone and playback while running — in line with the race organiser's rules (some races prohibit or restrict earbuds or tracking devices), traffic and other laws, and their own state of health. Cheerlify is not a race organiser and not an official timing service.
4.4. Involving others. If you invite a co-runner to your race or pass a race link on to someone else, you are responsible for being entitled to do so and for the person knowing about the tracking. You must not use Cheerlify to track anyone without their knowledge and consent.
4.5. If you send a video cheer, anyone else who appears in it (especially children) must agree to it (for a child: a parent).
5. Purchases, credits, right of withdrawal
5.1. Cheer credits and packs are purchased in the Cheerlify app through the app store's in-app purchase system (Apple App Store on iOS, Google Play on Android). The seller is the app store (Apple or Google): the store shows the price and any taxes before you confirm, handles the payment and issues the receipt. The provider never receives card details.
5.2. One credit is used from the runner's balance each time a follower sends a cheer (the follower does not pay). Credits carry over between the events on your account. Credits do not expire while the account exists, have no cash value and cannot be transferred to another account.
5.3. Right of withdrawal. Credits and packs are digital content made available immediately after purchase. By confirming the purchase you expressly request immediate performance and acknowledge that you thereby lose the 14-day right of withdrawal. This is also shown next to the purchase button.
5.4. Refunds. As the app store is the seller, refunds are requested through its own process: Apple — reportaproblem.apple.com; Google Play — your Google Play order history or Google Play Help. If you did not receive what you bought (e.g. the credits did not appear), write to support@cheerlify.com and we will fix it. If the app store refunds a purchase, we may withdraw the corresponding, still unused credits or pack from your account. If you ask Apple for a refund, Apple may ask us how much of the purchase you used; we then only tell Apple whether you received it and what share of it you used (details in the Privacy Policy). By accepting these terms you agree to this.
5.5. Unused credits and unused packs are lost when the account is deleted, because they belong to the account and cannot be assigned to anyone after deletion. Before deletion the app warns you about your remaining balance so you can use it first. If we discontinue the service (11.4), we refund unused purchased credits and packs pro rata.
5.6. We may change prices at any time; a change does not affect products already purchased.
6. Quality, availability, updates and changes to the service
6.1. We provide the service in accordance with the contract and the consumer rules on digital content. If the service does not work as it should, tell us at support@cheerlify.com; we fix the defect within a reasonable time or, if that is not possible, you may exercise your other statutory rights.
6.2. We provide the updates needed for operation and security. App updates are released through the app store; old versions may stop working after a while. We are not liable for defects caused by an update you did not install.
6.3. GPS tracking, pace and the estimated arrival time (ETA) are estimates and may be inaccurate or delayed depending on the phone, the network and the quality of the GPS signal.
6.4. Availability. We aim for continuous operation but do not guarantee that the service is available without interruption or error. The service may be paused for maintenance; where foreseeable, we try to schedule it outside race periods and announce it in advance. The service also depends on third-party systems (app stores, operating systems, map and e-mail providers, mobile networks); their outage or change may affect operation.
6.5. Changes to features. We develop the service: we may introduce new features and modify or discontinue existing ones for security, technical, legal or operational reasons (e.g. a third-party service is discontinued), provided this involves no additional cost for you. If a change negatively affects a material feature of a pack or Season Pass you have already bought, we give at least 30 days' notice and you may terminate free of charge within 30 days of the change taking effect; the affected, unused purchase is then refunded pro rata.
6.6. Force majeure. We are not liable for delay or failure caused by events beyond our control that we could not prevent (e.g. natural disaster, power outage, internet backbone failure, action of an authority, a decision of the race organiser or the app store).
7. Acceptable use, moderation, reporting
7.1. Do not upload or send content that is illegal, harassing, hateful, infringing, or that you have no right to share. Do not use Cheerlify to track or monitor anyone without their knowledge and consent. In particular, the following are prohibited: threatening, sexual, violence-glorifying or child-endangering content; impersonating another person; unsolicited advertising; malicious code; automated querying or copying of the service; circumventing access limits, bans or the credit system; interfering with the operation of the service; using the service while driving.
7.2. Removal of content and suspension. We may remove content, or suspend access, that violates these Terms or is illegal. Where the recipient is known, we send a short statement of reasons (what we removed, why, and under which rule) and explain how to complain. For serious or repeated violations we may also ban the author: their account is suspended and their device is excluded (see section 2 of the Privacy Policy on device identification), so they cannot join a race, send a cheer, clap or chat message even after reinstalling. If they have an account, we notify them by e-mail; they can complain under 7.4. Our measures are proportionate: we normally remove the content or warn first, and ban only for serious or repeated violations. In case of a ban, no refund is given for unused purchased credits if the ban resulted from your intentional or grossly negligent violation.
7.3. Reporting illegal content. Anyone — not only the runner — can report content they consider illegal via the "Report" button next to a cheer or at support@cheerlify.com. Say which content it is and why you consider it illegal. A person reviews every report, and we tell you the outcome. We may limit repeated, manifestly unfounded reports. If content raises the suspicion of a criminal offence threatening someone's life or safety, we notify the authorities.
7.4. Complaints about a decision. You can complain about a moderation decision within 6 months at support@cheerlify.com; we will review it again.
7.5. How we moderate. Content is moderated by human review; we do not use automated decision-making. Runners can hide cheers and block senders on their own races.
8. Your content and intellectual property
8.1. The cheers and routes you create remain yours. You grant Cheerlify a non-exclusive, free, worldwide licence for the duration of the service as needed to store and process them (e.g. transcoding, trimming, conversion for playback, generating the spoken intro), deliver them to the runner and show them in the race recap. The licence ends when the content or the account is deleted (except data we must keep by law). We do not use your content for advertising, do not sell it and do not use it to train artificial intelligence.
8.2. You warrant that you are entitled to use the content you upload or send (audio, video, text, route, image), that it does not infringe anyone's rights (in particular personality, copyright or trademark rights), and that the people appearing in a recording have agreed to appear.
8.3. If the runner downloads the recordings or recap of their own race and shares them elsewhere (e.g. on social media), the runner is responsible for that; further use of downloaded material no longer takes place within Cheerlify.
8.4. Cheer voice and video recordings are kept for a limited time: from race day, 14 days on a free race, 30 days with a Race Pack and 90 days with a Marathon Pack (or the Season Pass). We e-mail the runner 7 days before deletion; until then they can download the recordings from the recap one by one or all at once. After a recording is deleted, the fact of the cheer (who, when, where) stays in the recap. We are not liable for deletion after the retention period or for the loss of data stored on your own device; the service is not an archiving or backup service.
8.5. Cheerlify's intellectual property. The app, the website, the software, the design, the logos and Cheerlify's own content are the provider's intellectual property. For the term of the contract you receive a personal, non-exclusive, non-transferable, revocable licence to use the app and the website as intended, for private purposes. You may not copy, modify, distribute or reverse-engineer the app, except to the extent expressly permitted by law.
8.6. Feedback. If you send us ideas or suggestions, we may use them without compensation or restriction to improve the service.
9. Safety and your risks
9.1. Cheerlify is not a safety, emergency or navigation service. In an emergency call your local emergency number (112 in the EU). Do not rely on Cheerlify to check a runner's safety or to judge whether someone is in trouble. A gap in tracking or a stationary position does not by itself mean the runner is in trouble — and a moving position does not mean they are not.
9.2. Running is your risk. You use Cheerlify while running at your own risk. Running and every sport involve physical strain and the risk of injury. You decide, based on your health and preparation, whether to take part in a race; if in doubt, ask your doctor. Cheerlify gives no medical, training or nutrition advice; pace, distance and time data are informational, not official results.
9.3. Sharing is the runner's decision, and the runner accepts its risks. The runner decides who gets the race link and code; from the moment tracking starts until the race is closed — including the wait before the start — everyone who has the link sees the runner's precise live position and the route covered so far. You accept the safety, security and other risks of sharing your location — for example that someone learns from your position where you are, where you are staying or where you live. These risks may be greater depending on your circumstances (e.g. if you are well known, hold a position of trust, or someone is harassing you). Followers can record what they see (e.g. with a screenshot) and pass it on; we cannot prevent that. The runner can close the race at any time and ban followers; we cannot prevent the link from being passed on, so share it only with people you trust. We recommend starting tracking near the start line (not at home or where you are staying), and checking after the finish that the race has closed: with an uploaded route it closes automatically when you reach the finish; without a route you close it with Finish.
9.4. Playback while running. Cheers play in the runner's earbuds while running. The runner is responsible for setting the volume, ducking or pausing their music and turning playback on in a way that suits their own safety (e.g. in traffic or at crossings), for still hearing their surroundings (traffic, marshals' instructions), and accepts this risk by signing up. If the race organiser prohibits earbuds, do not use playback.
9.5. What others send. We are not liable for what the people the runner shared the link with send to the runner (cheers, chat) — that is their own content. We remove illegal content promptly once reported (section 7), and the runner can hide cheers and block senders. We do not check cheers before delivery; the runner can switch playback off at any time.
9.6. Battery and data. Continuous GPS tracking and playback use the phone's battery and mobile data. The runner is responsible for the phone lasting until the end of the race; we are not liable for resulting damage (e.g. a flat phone after the race). You bear the cost of mobile data — especially roaming at races abroad.
10. Liability
10.1. We are liable without limitation for damage caused intentionally or by gross negligence, for breach of contract causing death, personal injury or damage to health, and in every case where the law does not allow liability to be limited or excluded (e.g. our statutory liability for the conformity of digital content).
10.2. In all other cases — i.e. for slight negligence — we are liable only for the breach of essential contractual obligations (obligations whose performance makes the purpose of the contract possible at all and on which you may normally rely), and only for foreseeable damage typical of such contracts. The compensation payable is capped at HUF 20,000; if you paid more than that for the service through the app store in the 12 months before the event causing the damage, it is capped at the amount you paid.
10.3. Within the limits of 10.1, we are not liable in particular for:
- tracking or a cheer being delayed or not arriving because of the phone, the network, GPS, the operating system or a third party (e.g. app store, internet or map provider), or for the position, pace or ETA being inaccurate;
- accident, injury or damage to health during running, the race or playback while running, unless caused by our intent or gross negligence (section 9);
- consequences of breaching the race organiser's rules (e.g. disqualification);
- content deleted after the retention period or with the account, or the loss of data stored on your device;
- loss of profit, indirect and consequential damage, and loss of data;
- damage resulting from careless handling of your login details, or from giving the race link to someone you should not have;
- damage caused by someone who has the race link, or to whom it was passed on, using the location they saw (section 9.3).
10.4. Third-party content. The sender is responsible for content sent by followers and other users (cheers, chat, video). We act as a hosting provider: we do not create the content and do not check it before delivery; we remove illegal content promptly once we become aware of it (section 7).
10.5. Your responsibility. If a third party or an authority takes action against us because your content or your use of the service was unlawful or breached these Terms, you reimburse — in proportion to your fault — our reasonable, documented costs arising from it (including justified legal costs). We inform you of the claim without delay and give you the opportunity to state your position.
10.6. The exclusions and limitations above apply to the fullest extent permitted by law and exclude our liability in every case where the law allows it; they do not extend to cases where the law does not allow liability to be limited or excluded. Your rights under the mandatory consumer-protection rules of the country where you live are not affected by this section.
11. Term, termination and discontinuation
11.1. The contract is concluded for an indefinite term. You may terminate at any time, without giving reasons, by deleting your account (in the app: Profile → Account, or at cheerlify.com/delete-account). A follower's contract ends when the race is closed or when they ask for their recording to be deleted.
11.2. Termination by us for breach. If you breach these Terms, we ask you to stop the breach; if you do not within a reasonable time, we may terminate the contract. For serious breaches (e.g. harassing others, illegal content, attacks on the service, circumventing the credit system) we may terminate with immediate effect (7.2).
11.3. Ordinary termination by us. We may terminate the contract by e-mail with 60 days' notice; unused purchased credits and packs are then refunded pro rata, and you can still finish your active races during the notice period.
11.4. Discontinuing the service. If we discontinue Cheerlify as a whole, we give at least 60 days' notice by e-mail and in the app, let you download your content, and refund unused purchased credits and packs pro rata.
11.5. Consequences of termination. On termination we delete your account and content within the periods set out in the Privacy Policy. Sections 8.5, 10, 13 and 15 continue to apply after termination.
12. Changes to these Terms
12.1. We may change these Terms for these reasons: a change in the law or a decision of an authority; introducing a new feature or product, or discontinuing one; security; a material change in how the service works; a change in the provider's legal form (e.g. from sole trader to a company).
12.2. We give at least 7 days' notice of a change by e-mail and in the app. If you do not accept it, you can terminate free of charge before it takes effect by deleting your account. Earlier versions remain available on the website (2.2). A change that is solely to your benefit or required by law may take effect on shorter notice.
13. Complaints and disputes
13.1. Complaints can be made in writing: by e-mail (support@cheerlify.com) or by post to the registered seat. We do not run a telephone customer service. We examine each complaint on its merits and answer in writing within 30 days, giving reasons for a rejection. Complaints and answers are kept for 3 years.
13.2. If we reject your complaint, as a consumer you may turn to an out-of-court dispute resolution body. The one competent for our seat:
Budapest Conciliation Board (Budapesti Békéltető Testület) — seat: 1016 Budapest, Krisztina krt. 99. 1st floor 111. · postal address: 1253 Budapest, Pf. 10. · e-mail: bekelteto.testulet@bkik.hu · phone: +36 1 488 2131 · web: bekeltet.bkik.hu. Consumers in Hungary may also use the board of their own county (list: bekeltetes.hu). Consumers elsewhere can turn to the dispute resolution body of their own country; for cross-border disputes the European Consumer Centres Network (ECC-Net, the centre in your country) helps for free. We cooperate in conciliation proceedings; we do not accept the outcome in advance as a unilateral undertaking, but we examine every decision of the board on its merits.
13.3. You can also turn to the consumer-protection authority competent for your residence, and to the courts.
13.4. Purchases through the Apple App Store or Google Play are contracts with Apple or Google; disputes about them (e.g. refunds) go through the store's own process.
14. The app stores
14.1. Use of the iOS app is also governed by Apple's standard Licensed Application End User License Agreement; these Terms supplement it. Apple is not responsible for the app's content or support. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
14.2. Use of the Android app is also governed by the Google Play Terms of Service. Google is not a party to the contract between us and is not responsible for the app's content or support.
15. Governing law and other provisions
15.1. These Terms are governed by Hungarian law. This does not affect the mandatory consumer-protection rights of the country where you live. As a consumer you may also sue in the courts of your country of residence, and we may sue you there.
15.2. Assignment. We may transfer our rights and obligations under the contract to a business that takes over the operation of Cheerlify (e.g. a company founded by the provider); we give at least 7 days' notice, and if you do not accept it you may terminate free of charge by deleting your account. You may not transfer the contract.
15.3. Severability. If a provision is invalid, the validity of the other provisions is not affected; the relevant statutory rule applies instead of the invalid provision.
15.4. Contact. You can contact us by e-mail (support@cheerlify.com) or by post; we send notices to the e-mail address on your account and in the app. Please keep your e-mail address up to date.
